CHANDIGARH CONSUMER COURT FINES TWO BANKS FOR ‘FAILED ATM TRANSACTION’

The Hush Post: The District Consumer Disputes Redressal Forum has imposed a fine on two banks in a case pertaining to a failed ATM transaction. The complainant had tried to withdraw cash from an ATM, but neither the cash came out, nor did the bank reverse the money. The Forum pronounced its decision on the plea of Zirakpur resident Nitika Sharma.

In her complaint, Nitika had stated that on April 5, 2016, she and her brother visited a YES Bank ATM and tried to withdraw Rs 10,000. The ATM did not dispense any cash, but instead Rs 10, 000 were debited from her HDFC account.  She complained to her bank’s customer care, which in turn asked YES Bank to reverse the money, but it refused to do so. The complainant had also filed an FIR with the police in this connection, but to no avail. She finally approached the consumer court. The court has imposed a fine of Rs 10,000 on both the banks and also asked them to pay an additional Rs 8,000 as court charges. The Court also directed to reverse the said Rs.10,000 into the complainant’s account.
