Supreme Court shifts trial of Kotkhai custodial death case to Chandigarh

The Supreme Court has shifted the trial in the Kotkhai custodial death case to Chandigarh. The trial in this case, related to the infamous Gudia rape and murder case, was underway in Shimla.

Reports say, all the nine accused policemen in the case had requested the transfer of the trial outside Himachal Pradesh. The apex court acceded to the demand and ordered shifting of trial from Shimla to Chandigarh.

The accused include- former IGP Zahoor Zaidi, ex-SP DW Negi and former DSP Manoj Joshi who are out on bail. The rest six policemen continue to be in judicial custody.

The Supreme Court had released Zaidi on bail while Himachal Pradesh High Court gave bail to DW Negi. The CBI had arrested the nine policemen for the custodial death of one Suraj who was detained by Kotkhai police in the Gudia rape and murder case along with five others.

The CBI in its charge sheet filed in May last year had revealed that the arrested persons- Rajendra Singh, Lokjan, Subhash, Deepak and Suraj and another person Ashish Chauhan were not found guilty and recommended that they should be discharged under section 169 of the CrPC.

Notably, Gudia was raped and then murdered in July 2017. Her naked body was found in the jungle of Kotkhai. The CBI is probing both the cases.
