Muslim woman forced to undergo serial Nikah-Halala (sexual intercourse) with father-in-law and brother-in-law

A Muslim woman was forced to perform ‘nikah halala’ with both father-in-law and brother-in-law in a time span of six years. In Bareilly, Uttar Pradesh, the woman who married her husband in July 2009, claims that she was given instant divorce (triple-talaq) first time in 2011 for not having children.

When the family of the woman asked to reconsider his decision, the husband demanded his ex-wife to perform ‘nikah halala’ with his father. However, she refused to do so. Afterwards, she was given sedatives and got married to her father-in-law in that sedative state only. She was raped by the husband’s father for 10 days before marrying her husband again.

Again in January 2017, the husband issued triple talaq to her. When asked to marryng the woman again for the third time, the husband again put forward the nikah-halala condition. This time he was forcing her to marry his younger brother.

The woman then decided to approach the court. In the appeal to the court, the woman sought maintenance from her twice-married-twice-divorced husband.

“Nikah Halala” is an Islamic practice, prevalent in India and practice mostly by Sunni Muslims, wherein a woman once divorced by a man, can only remarry the same man after she has married, consummated and divorced the other man.

The police have registered a case against the halala victim’s husband and her in-laws.
