The court of Ludhiana Chief Judicial Magistrate (CJM) reverts the order of trial court that had convicted Hawara in the seizure of AK 56 rifle case and had referred to CJM for deciding of quantum of conviction
CJM Suresh Kumar Goyal has acquitted Hawara in by setting aside order of trial court of Judicial Magistrate
The Hush Post, Ludhiana: The court of Ludhiana Chief Judicial Magistrate (CJM) Suresh Kumar Goyal has acquitted Jagtar Singh Hawara in the case of recovery of an AK 56 rifle by setting aside the order of trial court of Judicial Magistrate Ist Class Varinder Kumar.
On April 9, 2018, the trial court of Judicial Magistrate Varinder Kumar had convicted him and referred the case to the court of Chief Judicial Magistrate Suresh Kumar Goyal for quantum of conviction as the trial court of Judicial Magistrate has power to order for conviction only upto three years.
On Monday, presence of Hawara was made through video conference as he has been lodged at Tihar Jail, New Delhi. The defence counsel Jaspal Singh Manjhpur claimed during arguments that Hawara had been falsely implicated in the case. On December 6, 1995, an FIR was registered at police station after seizure of an AK 56 rifle from near Clock Tower area.
Besides, Hawara was named in a bomb blast case that took place on the same day (December 6, 1995) near Clock Tower chowk in Ludhiana. According to the prosecution, Hawara had confessed the above mentioned facts during investigation. After the detailed examination of witnesses, evidence and arguments of the both sides, trial court found Hawara guilty and convicted accordingly.
For quantum of conviction, the trial court of Judicial Magistrate Varinder Kumar had referred the said case to court of Chief Judicial Magistrate as the trial court of Judicial Magistrate cannot convict the accused more than three years.
The court of CJM Suresh Kumar Goyal after hearing the arguments of defence counsel Jaspal Singh Manjhpur and acquitted Hawara in the above mentioned case.
