The Hush Post: Managing Director of Sunny Enclave near Kharar, Jarnail Singh Bajwa has been sentenced to two-year imprisonment for unfair trade practices by the Punjab State Consumer Redressal Commission. He was also directed to pay a fine of Rs 10,000 by the court.
Earlier, there was a complaint by Harjinder Singh, a Sector 49 resident that he had paid Rs 20 lakh for a villa in a project of Mariner’s Biuldcon in Mohali eight years ago. There was a pact between Bajwa Developers and Mariner’s Buildcon. However, the construction of the project did not take-off. Harjinder then sought a refund, which was not given subsequently he was left with no option but to move the commission.
In 2016, the commission ordered a refund of Rs 20 lakh, along with Rs 2 lakh compensation and Rs 21,000 as the cost of litigation. However, the order was not complied with and Harjinder filed an execution petition in 2017.
The present order has found Bajwa Developers guilty in the latter case. The upcoming project was in Sector 123, Mohali. It promised 200 independent villas. As per the complaint filed, by September 2012, Harjinder had paid Rs 20 lakh through four cheques. In June 2013, Harjinder was allotted a 300-yard villa. However, the company did not start construction work.
