Four boys – aged 6 to 12 – accused of gangraping a 4-yr-old, sent to juvenile home

The medical of the victim, however, has ruled out rape.

The Hush Post: Four minor boys, aged six to 12 years, have been accused of gangraping a 4-yr-old minor in Kanpur, Uttar Pradesh. The boys are currently lodged in a juvenile correctional home on the orders of the Juvenile Justice Board (JJB).

The girl’s parents have alleged that the four had “lured their daughter” to an “abandoned place and sexually assaulted her” reported The Indian Express quoting SHO of the Maharajpur Police Station, Rakesh Maurya.

The medical of the victim, however, has ruled out rape. “The girl’s medical examination did not confirm sexual assault,” Maurya said.

The incident is reported to have taken place this Saturday in the Maharajpur area of Kanpur district after which an FIR was lodged and the boys were detained by the police. The boys – aged six, seven, 10 and 12 – were booked under relevant sections of the IPC , including gangrape, and Protection Of Childern from Sexual Offences (POCSO) Act. The four were on Tuesday sent to Juvenile Home for counselling after their three-day remand.

The four had watched porn content on a mobile phone and lured away a 4-year-old girl playing outside her home, reported DNA.

Victims’ parents refute charges, says, “my son kept crying”

The father of the youngest boy has refuted the charges claiming them to be a result of personal animosity. “The children are innocent. I do not understand how they can sexually assault someone. On Saturday they were all just playing. Next day, I was told that there is an FIR against them for gangrape. The police came to the village on Sunday and first took the two older boys. They also took my 15-year-old son, who was not named in the case, to the police station. The cops asked me to first bring my youngest son named in the case and only then my elder son would be allowed to go,” the man told The Indian Express.

“Then I took my younger son to the police station on Sunday afternoon. The four boys spent a whole night at the police station. My son kept crying. The boys were begging us to not let the police take them, but we did not know what to do. We were helpless”, he added.

Proper legal procedure followed

Since the case involves a minor victim and a minor accused, and the medical report states otherwise, the Kanpur police is baffled over slapping POCSO Act against the tenderly aged boys. Meanwhile, senior police officials say that proper legal procedure has been followed.

Inspector General (IG), Kanpur (Range), Alok Singh said, “We talked to all the kids and based on their statements, it technically fell under the category of rape. However, this is a very sensitive matter and that is why we were very cautious and proceeded to keep in mind their mental health”.

“They seem have got excited and indulged in fondling her genitals and blow job after failing to penetrate,” the DNA quoted the Kanpur Police.

Experts feel that the actions of the boys may come under the non-penetrative category of sexual abuse, hence they can be tried under the POCSO Act.  The Kanpur Police has sought legal opinion in the case.
